This section provides a procedure by which persons submitting information in any form to the Commission can request that the information not be disclosed pursuant to a request under the Freedom of Information Act, 5 U.S.C. 552. This section does not affect the Commission's right, authority, or obligation to disclose information in any other context. 17 C.F.R. §145.9(a).

A request for confidential treatment (as distinguishing from the material that is the subject of the request) shall be considered a public document. 17 C.F.R. §145.9(d)(6).

PRIVACY ACT STATEMENT

This notice is being provided pursuant to the Privacy Act of 1974, 5 U.S.C. § 552a(e)(3), to inform you about why the Commodity Futures Trading Commission (“Commission”) is collecting this information.

Authority: The Commission’s authority to collect this information derives from procedural requirements of the Freedom of Information Act (FOIA), 5 U.S.C. § 552, and the Commission’s regulations at 17 C.F.R. §§ 145.5, 145.7, and 145.9.

Purpose: The information you provide here will be used by the Commission primarily to evaluate your request for confidential treatment and to determine whether information will be withheld in response to a FOIA request.

Routine Uses: In addition, it is possible that the Commission may disclose the information that you provide to a third party pursuant to a “routine use” where such a disclosure is required by law or otherwise deemed necessary and appropriate. Effect of Not Providing the Information: Providing the information is voluntary; however, if you do not provide the information requested, it may not be possible for the Commission to process your request for confidential treatment.
