The Freedom of Information Act (FOIA), 5 of the United States Code, section 552, provides that any person has the right to request access to Federal agency records. Upon receiving a written request, agencies are required to disclose records except for those records that are protected from disclosure by the nine exemptions and three exclusions of the FOIA.

You will receive an acknowledgement letter from the CFTC FOIA Office when they receive and begin processing your request.

After 65 minutes of inactivity, your form will timeout and all data will be lost. You will then need to re-access the form and enter your data again.

PRIVACY ACT STATEMENT

The collection, maintenance, and disclosure of this information is governed by the Privacy Act of 1974 (5 U.S.C. § 552a).

  1. PURPOSE


    The Freedom of Information Act (FOIA), 5 U.S.C. § §552, provides that any person has the right to request access to Federal agency records. The information provided will enable the Commodity Futures Trading Commission (“CFTC” or “Commission”) to process the FOIA request.

  2. AUTHORITY


    The Commission’s collection of this information is authorized under 5 U.S.C. § 552 and 17 C.F.R. § 145.7.

  3. ROUTINE USES


    The information will be maintained and any disclosures will be made in accordance with the Commission’s system of records notice CFTC-39, Freedom of Information Act Requests, available at 83 FR 34123.

  4. EFFECT OF NOT PROVIDING INFORMATION


    Providing this information is voluntary. However, failure to provide all of the information may preclude the processing of your FOIA request.
